Will Land Registry need accurate plans of the flat we're buying?
Q We are due to complete in a week's time and we've run into some trouble regarding the loft conversion in the flat we are buying. The vendors do not have any accurate drawings of the area since it was converted, only basic plans that have no dimensions and do not show the full living space correctly. Our solicitor now has the task of presenting these to the Land Registry and while he is hopeful they will be accepted, I can't help but feel that we should be submitting more accurate plans in order to avoid complications further down the line. I do not feel it is our responsibility to pay for these to be drawn up, especially as the conversion was done two years ago and they should have been submitted at the time. However, the vendors have been hard work to date and I know they will want to avoid paying for the plans themselves. Do you know how detailed the drawings need to be for the Land Registry to accept? Also, having just exchanged, are we in any position to get them to pay for new plans to be drawn up? OG A To answer your first question, you can find detailed guidance on what the plans should look like – as well as examples of unacceptable plans – on the Land Registry website. Look in the Education and Training section under Registering leases and leasehold interests. I think you could be right to be worried about the level of detail as plans should include: • a site plan showing detail in relation to the Ordnance Survey map; • plans of each floor level; • a recognised scale for both of the above; • north point; • a clear edging showing the land. However, not all registered leases have to have drawings. According to the Land Registry, you don't need a detailed plan if it is possible accurately to identify the extent of the property leased from a verbal description alone. It may be that you don't need plans – but if you do, I would say that it is the responsibility of the vendors to pay for and submit them.
